This is going to be complicated, so if you have any questions or need clarification please ask.

This is not about me, but will be easier to explain in first person.

Last year, I got two tickets. One for speeding and one for failure to dim headlights. I got these tickets in VA, my license is in CA. I was unable to pay them at the time ($300) so I got them postponed until after Christmas. Well, the lady at the VA court "forgot" to postpone one, so the price was higher ($500). I still have not been able to pay them and my license is suspended in the state of VA (maybe ca?). There is probably a bench warrant as well. My tags are expired and I have no proof of residence. I want to get my license transferred to TN. So I have quite a few questions:
What can I do?
Will I be arrested?
Can I just transfer without retaking the test?
If I can transfer to TN will VA "forget" my ticket?

Thanks for any help.
 
I'm pretty sure VA will not forget your ticket and if you're in VA again and pulled over it would not be good. I'm not sure how the DMV works as far as processing new licenses, however I believe a social security number is required for licenses in all states--if you try to test in TN and there is bench warrant out for you then I'm sure you will not be given a license in TN.
 
She'll have to pay off the fines before she can transfer her license. Normally when someone gets their license back, assuming she has a normal Class C license, they don't have to retest. No state will just forget she got the ticket!! Will she be arrested? It depends on if she's really nice and sweet and apologetic and the person she's talking to is in a good mood.
 
You (they) are going to have a hard time trying to get a drivers license in TN (or most other states) until those tickets are paid for and residence is established. http://www.tennessee.gov/safety/driverlicense/dlnew.htm

And I think Sami means that a "normal" license is a class D license. :)

ETA: If the license is already suspended, they will not be able to transfer the license to another state, as there really isn't one to transfer, at least until the suspension is lifted/tickets are paid.
 
I think it depends on what state you're in, Amanda. Our "Class C" is the regular license, so MD might be C also.
 
Many states anymore are inter linked, the original fines need to be paid, if they pay via mail it can be taken care of and once it's paid the warrant will go away. Then they can get a new license.

Not to sound mean here but paying the fines is something that comes with driving privileges, a DL is not a right. If the driver wasn't speeding and dimmed their lights there would be no fine to pay. I've never even heard of someone getting an extension on a fine without going in front of the judge, so they should consider themselves lucky for that alone. In Nebraska I've never heard of that, you are usually allowed about a month before the court date, or date that it needs to be paid.

If you don't pay your other bills your power or gas gets shut off, or you house or car get taken back, license is the same way.
 
You do not have to retest in TN IF you have a valid class D license from another state, however, a bench warrant in another state could prevent you from getting that license.
Why don't you have proof of residence?
To get a license in TN, you have to show a birth certificate or passport (SS cards will not work) so be ready for that.
Don't get pulled over in VA! You will go to jail!
 
If the two states work together you could go into get a license in TN and get arrested... if you get pulled over, same thing.
 
What Riven said is completely true. My mothers other kid had a bench warrant on him in Kentucky and he got pulled over with some friends in Ohio. He got arrested and held over the weekend before they transported him to the county he had the bench warrant in.

You should probably work on paying off those tickets :)
 
That happened to me, I got a ticket for a minor accident in WA. Got pulled over in ID (my state) He said "Do you know your license is suspended?" I think he could believe me because of the incredulous shrieking NO! I made. He gave me a ticket to appear in court, and told me to have it all taken care of before my court date. I thought OK, fine, done. I could not believe it when I got there and they inform me I could spend time in jail and face several hundred dollars in addition fines. I got off easy with an additional $300 in fines and I could have had my car towed and impounded which did not happen. Geez I wasn't drinking or anything, just a little fender bender on a ice covered road. Go take care of it.
 
Wow Im not the only road Heathen here. But I've never let a ticket go unpaid. I have heard that tickets in other states dont count on your current state license.

I want to know how you have a suspended license in VA if you never had one in the first place. I know if you moved there you would have issues getting one issued.

Why not just call up and ask. They arent going to come and arrest you for making a phone call to find out.
 
Call them and ask what you can do. Everyone on here will tell you what you can do based on their state and their experiences, but every county is different. You need to call the courts and make an appearance before the judge to ask for leniency and explain your situation. Sometimes going in front of a judge and just openly admitting you were in the wrong and in a tough financial situation will help. My friend had her license suspended in CA and a $700 fine. She went to court and pleaded guilty before the judge and he reduced her fine to $500 and set up a payment plan for her. Don't be afraid to appear in front of a judge. If you have a court appointment, they won't arrest you for being in the state.

Most counties will let you call the courts and request an extension for the due date of the ticket fees. I got mine extended a month and my boyfriend had his extended four months (different counties). What the ticket is for and what county you got it in will limit the amount of time they give you on an extension but every court SHOULD offer this by phone. If you need a longer extension than what they automatically allow or would like to set up payments, you generally have to appear before a judge to set that up.

For the future, don't EVER leave a ticket unpaid! The fines that accumulate are so much more than just paying it off or setting up payments with the county.

You have heard wrong, it depends on the state, most states anymore work together regarding driving privleges. My husband got a DUI in Wyoming and his driving privileges there, and his license from Nebraska was revoked as well. To get his license back in Nebraska he had to get a letter from Wyoming first saying his privileges were reinstated.

If you have a warrant and you go in to pay the ticket, they can and will arrest you. They did it to me once. I thought the ticket had been paid, they sent me a letter and I went into pay it, they arrested me and ankle shackled me to a table in an interrogation room when I was 8 1/2 months pregnant. I had to have my grandmother come and get me out, she was beyond irate and the officer that handled it was the father of a friend of mine from school. He said that they had to because it was protocol, and actually they should have booked me and put me into jail, but since my grandma was in town and could bring cash for the fine he was able to bypass that.
 
We had a big situation here because a city councilwoman went to the casinos in another state, got pulled over and her license taken for DUI, and the next day went to a drivers license station and got another license before the states could line their systems up.
She was charged with driving on a revoked license and submitting false information for attaining a license. Then she was dumb enough to let a news crew film her driving for Meals on Wheels (another driving on a suspended license charge).

All that that said. Be careful.
 
Thanks guys, I forwarded the thread. So basically, they can mail in the money and not risk being arrested? And then pay the reinstatement fee?
 
Yes Erin, I asked them if a friend had brought mine in, or it was mailed if I'd have been arrested, they said no. Go figure huh.
 
REALLY??? Do you really want to drive around with a bench warrant for your arrest over your head??? You know that Karma is going to get you, and you know that Murphy's Law will guarantee that it is at a MOST inopportune time.

Suck it up, come clean, pay the fines and do WHATEVER ELSE you have to to get your clean record back again!!! :thumbsup:

Good God, life is too short to waste time worrying about getting thrown in jail!!!
 
LOL Lynn chill out. It isn't me. I don't speed, but i'd pay a ticket if I ever got one. I don't condone any of the behavior, im way to paranoid/panicky to not pay it off if it was mine.

By the way, from what I know, said person is not driving at the moment.
